This terms and conditions apply to Your purchace of Goods from Marcin Klysewicz Photography through www.klysewicz.co.uk (this website).

Reproduction of any of the images on the website is strictly forbidden. The term reproduction includes any form of publication or copying of the whole or part of a picture, whether altered or not, and whether by printing, photography, slide projection, xerography, electronic or mechanical reproduction or storage or for any use as artist's reference or illustration or in a layout or presentation.
Orders
I shall have the right to refuse to accept any orders placed for printings.
You shall be responsible for the accuracy of an order and for giving Me any information necessary for Me to perform the contract.
No order for printings shall be deemed accepted by Me until I send an invoice confirmation e-mail to You which summaries your orders and confirms that I have received payment.
I do try to make sure that all details contained within the Web Site are as accurate as possible. On the rare occasion that there is an error, I will advise You about it as soon as possible.
Please note that colours on prints ordered by You may vary from the colours that You see on the accompanying photography depending on your monitor display.
Cancellation and Refunds
Where applicable, You may cancel Your order in accordance with Your rights under the Distance Selling Regulations.
You have the right to cancel the contract for the purchase of Goods within seven working days of delivery of the Goods to You.
To cancel Your order You must email me entering the words 'Order cancel' in the subject title, within 7 working days of delivery of Your items, quoting Your order number. You must take reasonable care of the items whilst they are in Your possession. Please return the Goods to me in their original packaging. I advise that You use registered post in order to ensure safe return.
Return address will be emailed to You following Your order cancel request.
I will only refund the purchase price when I have received the Goods from You in an undamaged state. You will not obtain a refund of the return delivery charges.
You agree to pay the costs for returning the Goods.
Goods must be returned in the condition in which they were received.
I will make all refunds to the card used for payment.
I will refund Your payment for the returned Goods as soon as possible and in any case within no more than 30 days from the day I receive the Prints.
Delivery and Postage
Dates and times for delivery are estimates only and are not guaranteed. They are also subject to any matter beyond My reasonable control. As a general rule, I will endeavour to complete Your order within 3-4 weeks of the date of My acceptance of Your order.
In the event that I am unable to ship your order within these timeframes, You will be notified of the expected ship date and offered a refund if You choose not to wait.
You shall have no right to reject Goods and no right to rescind the Contract for late delivery unless the due date for delivery has passed and You have served on Me a written notice requiring the Contract to be performed and giving Me not less than 14 days in which to do so and the notice has not been complied with.
I deliver to mainland UK. I may deliver overseas but this is only on special arrangement and You must contact Me for details of delivery charges.
All deliveries are securely packed to avoid damage in transit and send to You by UK Mail using next day delivery. You will be required to sign for your delivery to ensure safe receipt.
Postage and packaging are free of charges for delivery within the UK.
Price and Payment
The price You pay is the price displayed in respect of the relevant Goods on this Web Site at the time I receive Your order.
All prices are inclusive of VAT at the current rate.
While I try and ensure that all prices on My Web Site are accurate, errors may occur. If I discover an error in the price of the Goods You have ordered I will inform You as soon as possible and give You the option of either reconfirming Your order at the correct price or cancelling it. If I am unable to contact You I will treat the order as cancelled. If You cancel an order due to an error in price and I have already received payment for the affected Goods, You will receive a full refund.
Payment is due at the time You place Your order. I use a third party, Paypal, to take Your payment for the Goods by either debit or credit card. When You proceed to the checkout and place Your order, You will be directed to the Paypal web site in order to submit Your payment details. Security of transactions is guaranteed by Paypal and Your credit card provider.
Faulty Goods
If You discover the Goods are faulty, You must notify Me of the defect within 7 days of the date of delivery.
I may ask You to return the Goods to Me for inspection before I send You a replacement. If the Goods are faulty, I will replace the faulty Goods at no additional cost to You and refund any reasonable costs You may have incurred in returning the faulty Goods to Me.
If You find Your Goods being damaged in transit You must contact Me within 48 hours of receipt. Failure to contact Me within this period will void any claim I will have against carrier and will indicate to Me that You have accepted the Goods.
Data Protection
When You Use My Web Site, You will be asked to provide certain personal information such as Your contact details. I will store the data that You provide to Me on computers or otherwise.
I will comply with the requirements of all Data Protection legislation in force in England and Wales from time to time. In particular, You may request a copy of any personal data held by Me about You upon written application.

General
I shall have no liability to You for any delay in performance to the extent that such delay is due to any event outside My reasonable control including but not limited to acts of God, war, flood, fire, labour disputes, subcontractor delays, strikes, lockouts, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events. If I am affected by any such event then time for performance shall be extended for a period equal to the period that such event or events delayed such performance.
All third party rights are excluded and no third party shall have any right to enforce this Agreement.
The laws of England and Wales shall govern the contract between Us and any dispute between Us will be resolved exclusively in the courts of England and Wales.
English is the only language offered for the conclusion of the contract.

Taking care of Your investment
To give your prints long life they must be treated correctly.
Both canvas and acrylic prints are easily damaged by damp or contact with water or water vapour.
Extreme temperature fluctuations should be avoided.
Although the ink used for my prints has a guaranteed fade resistant for about 70-100 years and will not fade in sunlight damage from sunlight can occur. It is rather recommended that the picture is not stored in direct sunlight.
The picture should be hung correctly against a flat wall. Incorrect hanging may result in the frame distorting or warping.
